Terms of Service & End User Agreement

Phlava ("Phlava," "we," "us," or "our") operates a web application based in Barbados that allows users to browse and purchase clothing items, purchase and receive tickets to events, participate in group purchase packages, and interact with event-day services such as food and drink service and on-site safety support. By creating an account or using Phlava, you agree to these Terms of Service and to our Privacy Policy.

You must be at least 18 years old to create an account or make a purchase on Phlava. By creating an account, you confirm that you meet this requirement.

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us immediately at phlavabarbados@gmail.com if you suspect unauthorized use of your account.

We reserve the right to suspend ("block") or permanently delete accounts that violate these Terms, engage in fraudulent activity, or misuse the platform.

Items. Certain items are restricted by gender category and are limited to one item per person, ever, across the platform. Attempting to circumvent this limit may result in order cancellation and/or account suspension.

Event tickets. Event tickets are not subject to a per-person purchase limit unless stated otherwise for a specific event. Tickets are non-transferable except through features we explicitly provide (such as group package assignment).

Group packages. A group package creator may invite other registered users to join a group and pay for their own item within it. The creator does not pay on behalf of other members. We reserve rules on the composition of group packages (for example, gender ratios) as displayed in the app at the time of purchase, and these rules may change.

Complimentary tickets. We may issue complimentary tickets at our discretion, which may carry a nominal recorded value for accounting and tax purposes rather than being valued at $0.

Pricing and availability. All prices are shown at checkout and are confirmed at the time of purchase. Availability is not guaranteed until payment is confirmed. We reserve the right to correct pricing errors.

Payment via CIBC 1st Pay requires you to complete a bank transfer for the exact amount shown at checkout. Your order is reserved once you begin checkout but is not confirmed as complete until we are able to verify your payment, whether automatically or manually by our staff. Orders not confirmed within a reasonable time may be automatically cancelled and any reserved inventory released. If you believe a genuine payment was not correctly confirmed, contact us at phlavabarbados@gmail.com with your order details.

If you attend an event associated with Phlava, you agree to comply with the venue's rules and applicable law, including laws relating to the service and consumption of alcohol. Event staff (including security personnel) may refuse entry or remove any person for safety reasons. Consumption data logged for safety purposes (see Privacy Policy, Section 2) may be accessed by on-site medical staff during an emergency.

Referral links are for tracking and, where enabled, discount purposes only. Referral discounts, where offered, apply according to the terms shown at the time and may be limited to a specific event, a specific number of uses, or a buyer's first purchase only, as described in the app. We reserve the right to disable or modify the referral program at any time.

You agree not to: use the platform for any unlawful purpose; attempt to circumvent purchase limits, pricing, or security controls; interfere with the platform's operation; misuse staff tools if you are granted a staff role; or attempt to access data or accounts that are not your own.

All content, branding, and design on Phlava (including the Phlava name and logo) are the property of Master Creations or its licensors. You may not copy, reproduce, or use them without permission.

Phlava is provided "as is." We do not guarantee uninterrupted or error-free operation of the platform. To the fullest extent permitted by law, we are not liable for indirect, incidental, or consequential damages arising from your use of Phlava, except as required by applicable law.

To the maximum extent permitted under the laws of Barbados, our total liability to you for any claim arising from your use of Phlava will not exceed the amount you paid to us in the 6 months preceding the claim.

We may suspend or terminate your access to Phlava at any time for violation of these Terms. You may request deletion of your account at any time as described in the Privacy Policy.

These Terms are governed by the laws of Barbados. Any disputes will be subject to the exclusive jurisdiction of the courts of Barbados, except as otherwise required by applicable law.

We may update these Terms from time to time. Continued use of Phlava after changes take effect constitutes acceptance of the updated Terms.
